IRDAI Rules Explained: A Simple Guide for Policyholders
Insurance works on trust, and at the same time, it should be backed by well-placed regulations. In India, the Insurance Regulatory and Development Authority of India (IRDAI) is responsible for overseeing the insurance industry.

The IRDAI sets the legal framework that governs every insurance company operating. Its regulations cover policy issuance, renewals, claim settlements, and other insurance-related processes.
Knowing the IRDAI rules is very beneficial to every policyholder to ensure fair coverage. This guide explains:
- What IRDAI does
- The rules it has set up
- What you can do when something goes wrong
What is IRDAI?
IRDAI mandate mainly covers two areas:
- Regulating the conduct of insurers and intermediaries
- Developing the insurance sector to increase penetration across India
Today, no insurance company can legally sell a policy in India without IRDAI registration. In fact, no policy product can be marketed without IRDAI approval.
What IRDAI Regulates
IRDAI’s authority is stronger than most policyholders understand. Its rules cover the entire insurance chain, from the insurer itself to the agent who sold you the policy.
- Insurance Companies: IRDAI provides the license to all life and general insurance companies operating in India. An insurer without IRDAI registration cannot renew policies or settle claims legally.
- Insurance Products: Every new product must be filed with and approved by IRDAI before it is offered to the public. IRDAI reviews all product terms, exclusions, and premium structures.
- Agents and Brokers: All insurance agents, brokers, and corporate agents must hold a valid IRDAI licence. Selling insurance without one is a punishable offence under the Insurance Act.
- Third Party Administrators (TPAs): Companies that process health insurance claims on behalf of insurance companies are also regulated by IRDAI. It sets all standards for claim processing timelines and data security.
- Premium Rates: IRDAI fixes the premium for third-party motor insurance. For other products, insurance companies can set the price freely within IRDAI guidelines.
- Investment of Policyholder Funds: IRDAI also mandates how insurers must invest the premiums collected. This ensures sufficient liquidity to pay claims even in urgent conditions.
Key Policyholder Protections under IRDAI Rules
IRDAI rules are useful as they are set to protect policyholders.
Standardised Policy Definitions
IRDAI rules have set the standardisation of key policy terms.
- There are mandatory standard definitions for various official terms related to insurance.
- Insurers cannot use any other definitions and reject any valid claims.
Before this rule, many insurers would use complex definitions in their policy wordings to reject claims. Standardised definitions prevent any company from deliberately rejecting valid claims.
Claim Settlement Timelines
Insurance companies cannot delay claims indefinitely. IRDAI sets mandatory timelines within which claims must be settled. In case the claim is not settled within the required time period, you can file a formal complaint and claim interest on the delayed amount.
| Type of Claim | IRDAI Timeline |
|---|---|
| Death claim (life insurance) | Within 15 days from the date of claim intimation |
| Health insurance (cashless) | Not more than 1 hour from receipt of request and 3 hours after receipt of discharge |
| Health insurance (reimbursement) | Within 15 days from the submission of the claim |
| Motor insurance (surveyor appointment) | Within 24 hours of reporting the claim |
| Maturity/survival benefit | On the due date |
Free-look Period
This protection exists because insurance contracts can be very complex. You may not fully understand the exclusions or conditions until you read the fine print after purchase. The free-look period gives you an easy option to exit without any financial penalties.
Under IRDAI rules,
- Every new policyholder receives a free-look period of 15 days after receiving the policy documents.
- For policies sold through distance marketing, this time is extended to 30 days.
Within this window, you can return the policy and receive a full refund of the premium.
Health Insurance Portability
IRDAI rules mandate health insurance portability. You can switch your health policy from one insurer to another at renewal without losing the waiting period. If you’ve served 2 years for a pre-existing condition with your current insurer, the new insurer must also credit those years.
Portability requests must be submitted to the new insurer at least 45 days before your renewal date. The new insurer is not obligated to offer you the same premium.
Note: The insurance company cannot reject your application only on the grounds of a pre-existing condition that you have already declared.
Mental Illness Coverage
IRDAI has issued a mandatory rule that all health insurance policies must cover mental illnesses as well as physical illnesses.
This covers conditions such as:
- Depression
- Anxiety disorders
- Schizophrenia
Insurers who previously excluded mental health conditions are now required to revise their policies accordingly.
Note: Coverage terms can vary across policies. You must review the specific product wording to understand all sub-limits, waiting periods, and coverage available for mental health conditions.
Important Reminder:
IRDAI rules aren’t optional guidelines for insurers. They are binding legal obligations, and violations can result in regulatory penalties.
How to Use IRDAI Rules When Something Goes Wrong
Knowing IRDAI rules is useful if you ever need to invoke them. IRDAI provides two formal channels for policyholder complaints.
Bima Bharosa Portal
The Bima Bharosa portal is a centralised online grievance registration system. It is accessible 24/7 to assist all policyholders. Through the portal, you can:
- Register a formal complaint against an insurer.
- Track the status of an existing complaint in real time.
- Escalate a complaint that your insurer has not resolved within 15 days.
- Access your complaint history across policies and insurers.
First-time users will need to register with a valid mobile number and policy details. Complaints are always assigned a unique reference number for tracking purposes.
IRDAI Helpline
IRDAI operates a toll-free helpline for complaints and general information.
- The helpline is available during working hours.
- You can talk to trained officers who will guide you through the complaint process or escalate urgent cases.
If you’re uncertain whether your grievance falls under IRDAI’s rules, this helpline can help you. Officers can also direct you to the Insurance Ombudsman if your dispute requires binding resolution.
What IRDAI Can & Cannot Do
There’s a common misperception that filing a complaint with IRDAI guarantees a claim settlement. Let’s take a look at what the IRDAI can and cannot do:
| What IRDAI Can Do | What IRDAI Cannot Do |
|---|---|
| License and de-license insurers | Directly settle individual claims on behalf of policyholders |
| Penalise insurers for regulatory violations | Provide legal advice or act as your representative |
| Mandate claim timelines and product terms | Override a contractual policy exclusion unless it violates regulations |
| Escalate systemic grievances against insurers | Guarantee outcomes in individual disputes |
| Refer cases to the Insurance Ombudsman | Issue binding judgments in civil disputes between parties |
Note:
If you want a binding resolution for a dispute, the Insurance Ombudsman is the appropriate route. Ombudsman offices handle complaints where the insurer has either rejected a claim or failed to respond within a reasonable period. The process is completely free of charge for policyholders.

FAQ
Frequently Asked Questions
How to use the free look period?
The free-look period gives you 15 days from the date you receive your policy document to return it for a full refund. To use it, contact your insurer within the specific window stating that you wish to cancel under the free-look provision. The insurer must process the refund after deducting proportionate risk charges.
Can IRDAI force my insurer to pay for claims?
IRDAI can’t directly order an insurer to pay a specific claim. What it can do is penalise insurers for systemic non-compliance with claim settlement rules. The IRDAI will direct your insurance company to review all decisions that violate its regulations. For a binding order on a specific claim, you’d need to approach the Insurance Ombudsman or a consumer court.
What are the IRDAI guidelines on insurance portability?
Under IRDAI guidelines, you can port your health insurance policy to a new insurer at renewal. You will not lose your accumulated waiting period credit. Submit your portability request to the new insurer at least 45 days before renewal.
What is the Bima Bharosa portal, and who can use it?
The Bima Bharosa portal is IRDAI’s centralised online grievance system. It is open to any policyholder who has an unresolved complaint against their insurance company. You can register complaints, track their status, and escalate any issues.
Is the Insurance Ombudsman different from IRDAI?
The Insurance Ombudsman is an independent dispute resolution body. Unlike IRDAI, the Ombudsman handles individual disputes. It can issue binding orders on insurers. The process is free for all policyholders. IRDAI and the Ombudsman work in parallel.
